What you can count on, and what we ask of you.

These are the terms for using Soulberry, written to be read. Where the law gives you a right, nothing here takes it away.

By making an account or using Soulberry, you agree to these terms. The privacy page sits beside them and says what is stored, and where. If you read only one part, read section 2. It says what Soulberry is not.

1. Who we are

Soulberry is run by one company:

In these terms, "we" and "us" means that company, and "you" means the person using Soulberry. Email is how to reach us, about anything. That address is also our single point of contact under the EU Digital Services Act, for users and for authorities. We answer in English or Romanian.

2. What Soulberry is, and what it is not

Soulberry is a private place to put what you are carrying: three AI guides to talk to, a journal made of small fragments, and a few gentle moments in your day. It is a companion for everyday wellbeing.

It is not therapy, not medical treatment and not a clinician. It does not diagnose anything, and it does not replace a doctor, a therapist or any other professional. Nothing a guide says is medical advice.

Not for emergencies

Soulberry is not built for a crisis. If you are in crisis, call your local emergency number now, or find a helpline in your country at findahelpline.com.

3. The guides are AI

The guides' replies are written by Claude, an AI made by Anthropic. To write a reply, Soulberry sends Anthropic what you write to a guide. When you ask for a question about a fragment, or for your day's story, those fragments are sent too. The app asks you first, and nothing is sent until you agree. You can take that back in Settings, under Privacy, and nothing more is sent.

An AI can be wrong. It can sound sure and still be wrong, misread you, or say something that does not fit your life. So:

The guides have names, faces and personalities. They are still AI, and their portraits are illustrations.

4. Your account

Right now, new accounts are not open to the public. Anyone can join the waitlist, and invitations go out in the order names arrive.

5. Your things: where they live, and who owns them

Your conversations with a guide are kept in your browser, on the device you had them on. They are not stored on our servers, and they do not follow you to another device. If you clear this site's data in your browser, or lose the device, they are gone, and we cannot bring them back.

Your journal and your days, your moments, and what you keep in Essence and Wisdom work differently. They are stored on our servers, so they are there on each device you sign in on. In Settings, Export everything gives you a copy of all your account holds on our servers, at any time.

What you write stays yours. You own what you write, record and upload, and we do not claim it. To run Soulberry, we need your permission to store it, show it back to you, and send it to Anthropic when you ask for an AI reply. You give us that permission by using Soulberry. It covers only that, and it ends when your content is erased.

The guides' replies are yours to keep and use for yourself.

Soulberry itself belongs to us, or to those who let us use their work: the name, the app, the site, the guides' characters and portraits, the words and the design. Using Soulberry does not give you a right to copy any of it.

6. Using Soulberry fairly

7. Paid plans

Nothing can be paid for yet. No price is published and no payment provider has been chosen. Soulberry's paid plan is called Soulberry Pro. When it goes on sale, this is how paying works:

8. Changing your mind, and refunds

14 days to change your mind

If you buy a plan for yourself, and not for a business, you have 14 days to withdraw from it, without giving a reason. The 14 days start on the day you subscribe. To withdraw, email hello@soulberry.ai and say so clearly. You can use the form below, but you do not have to.

A plan starts working the moment you pay. So checkout asks you to request that it start straight away, inside the 14 days, and to confirm you understand two things:

We send the refund within 14 days of hearing from you, to the payment method you used, at no cost to you. This follows Romanian consumer law (OUG 34/2014), which applies the EU's consumer rights rules.

9. Closing an account

When you close it

You can close your account yourself, at any time. In Settings, choose Close your account and enter your password. It stops working at once, on every device you were signed in on. If you pay for a plan, cancel it first.

For 30 days the account stays closed but not erased, in case closing it was a mistake. Email us in that time and we bring it back. After that, a job that runs once a day erases the account and everything our servers hold for it.

Two things are outside that. What your browser keeps, your conversations included, is on your device, not on our servers. Clear it before you close, with "Clear what is on this device" in Settings, or clear this site's data in your browser afterwards. And if you ever paid, the law makes us keep the payment records, with your name, email address and password taken off them.

When we may close it

We may suspend or close an account if its owner seriously or repeatedly breaks these terms. We may also do it if the account puts other people or Soulberry's security at risk, or if the law requires it.

Unless the law stops us, or warning you would help an attack, we email you first and say why. You can reply to ask us to look again, and a person will. If we close an account because its owner broke these terms, time already paid for is not refunded, unless the law says it must be.

10. How Soulberry can change

Soulberry is new and still being built. Features will be added, changed and sometimes removed. We cannot promise it will always be available or free of errors, and sometimes we take it offline for maintenance.

If a change makes a paid plan clearly worse for you, we tell you before it happens. You can then end the plan free of charge within 30 days, and get back what you paid for the time left.

If we ever close Soulberry for good, we email account holders at least 30 days before. That gives you time to export your things, and we refund any paid time not used.

11. Our responsibility to you

We run Soulberry with care. If we break these terms or the law and that harms you, we are responsible, as the law sets out.

We are not responsible for:

Where the law allows a limit, the most we owe you for everything in any 12 months is what you paid us in that time, or 100 euros if that is more.

What nothing here limits. These terms do not limit our responsibility for harm to your life, body or health, physical or mental; for harm we cause on purpose or through gross negligence; or for any right you have as a consumer that the law says cannot be given up.

12. When these terms change

We may update these terms, for example when paid plans open or the law changes. The date at the top shows the current version.

Which law applies

These terms are governed by Romanian law. If you use Soulberry as a consumer, you keep the protections of your own country's consumer law that no contract can take away. You can also bring a claim in the courts where you live. If you live in the EU, we can bring a claim against you only in the courts where you live.
